High Court Mandates Issuance of Seven Days Prior Notice to Sumedh Saini before Arresting Him

CHANDIGARH, Punjab—On October 11, the Ex-DGP of Punjab Sumedh Saini succeeded in securing relief from getting arrested immediately through a petition moved in the Punjab & Haryana High Court. It is learnt that the High Court bench headed by Justice Gurvinder Singh Gill has mandated issuance of a seven days advance notice to Sumedh Saini for the Punjab police as well as CBI to arrest him. However, the Court has turned down his request seeking withdrawal of probe from the Punjab police and transfer of probe to the CBI.

Notably, Sumedh Saini had moved a petition on October 10 seeking handing over the investigation in any matter registered against him to the CBI or any other independent agency outside Punjab. He had claimed in his petition that he was being targeted on account of “malice”, “mala-fide” and “ulterior motives” by the Congress led Punjab government as he had indicted Captain Amarinder Singh under corruption charges while being a part of Vigilance Bureau.

Going specific about the Kotkapura firing incident, Sumedh Saini has claimed in the petition that he was not present in Kotkapura on October 14 and he got apprised of the incident after an hour.

Sikh24 has learnt that Saini’s claims were opposed by the Punjab Advocate General Atul Nanda by revealing multiple murder cases pending against Saini before the Court.

Sources have informed that Nanda opposed the blanket bail to Saini by saying that the court could not pass an order granting protection to the petitioner from arrest ensuing from future FIRs. He said the petitioner had not brought to the court’s notice any FIR wherein he (Saini) was made an accused. Such an order merely on the basis of an apprehension would be in violation of the High Court’s power in the light of the law settled by the SC.
