Delhi High Court Questions State Machinery’s Inaction during 1984 Sikh Genocide

NEW DELHI—While processing a plea moved by the CBI challenging the Sajjan Kumar’s acquittal in a 1984 Sikh genocide case on July 13, a Delhi High Court bench headed by acting chief Justice Geeta Mittal and Justice Anu Malhotra wondered over what the state machinery was doing at that time. The bench said that such cases have not come to Court if the state machinery had responsibly tackled the situation.

The bench expressed extreme wonderment over the murder of five members of a family in an area situated right next to the Delhi Cantonment. Notably, five members of a family were brutally murdered by the Hindu mobs in Raj Nagar of Delhi cantonment area on November 1, 1984.

During the hearing, Sajjan Kumar’s counsel Amit Sibal said that the Justice GT Nanavati Commission had not directed authorities to re-investigate the case. But, the CBI counsel DP Singh and senior advocate HS Phoolka, who represented the genocide victims, contradicted Sibal and said that the Indian Parliament had decided to investigate these cases again.

It may be recalled here that Balwan Khokhar, Captain Bhagmal, Girdhari Lal and two others were sentenced to life in this case while Sajjjan Kumar was acquitted by the trial Court.

  1. Are the courts finally waking UP or is it just another delay action for long over due for JUSTICE for the genocide of sikhs .
