Californian Sikh & Muslim Groups to File Complaint Against Boomers! Amusement Park

18810_boomersSANTA CLARA, CA, USA—On Tuesday, April 29, UNITED SIKHS and the San Francisco Bay Area office of the Council on American-Islamic Relations (CAIR-SFBA) will hold a news conference in Santa Clara to announce the filing of multiple public accommodation complaints with the California Department of Fair Employment and Housing (DFEH) against Boomers! amusement parks, a subsidiary of Palace Entertainment Holdings.

The complaint alleges violations of California’s Unruh Civil Rights Act based on Boomers! unwillingness to permit park attendees wearing religious headgear from riding Go-Karts. Both Sikh and Muslim park attendees have repeatedly been denied access to the rides. The company, citing baseless safety concerns, has been unwilling to provide any accommodation, thereby effectively banning thousands of local residents from riding the Go-Karts solely based on their faith.

“Boomers! has failed to provide any clear or sensible reasoning for denying individuals with religious headwear requirements access to go-karts,” said UNITED SIKHS Staff Attorney Manmeet Singh. “To deny people their religious liberties on unfounded fears is something that cannot and should not be tolerated in today’s day and age.”

“Companies cannot utilize baseless safety concerns to discriminate against thousands of people,” said CAIR-Northern California Civil Rights Coordinator Brice Hamack. “It troubles us that every other amusement park is able to make sufficient accommodations to permit women wearing hijabs to ride some of the fastest roller coasters in the world, but that Boomers! has unequivocally denied them access to the Go-Kart rides.”

  1. The policy must have recently changed because before I was able to ride the gocarts with my turban. Why the sudden change in policy.

  2. Look, I am stating facts, and your censoring my statements of fact. You do not believe in TRUTH? You believe in the power of deception over the truth of our deeds in life?

    This is an absurd lawsuit. Their policy clearly states the following.

    We do not allow ANY headwear or neckwear on go‐karts. This includes: Hats, caps, visors, ear muffs, head phones, bandanas, scarves, ribbons, bows, neckties, turbans, yarmulkes, hijabs, doo‐wraps, wigs or head wraps of any kind. We do not distinguish amongst headgear based on religious issues, medical conditions, one’s fashion desires or anything else.

    Why Do We Have this Strict, “No Exceptions” Rule?

    Headwear and neckwear on a go‐kart track can be more dangerous than you realize.

    • Choking Hazard: Around the world, people have died when
    hijabs, scarves and other lengthy headwear or neckwear became entangled into a go‐kart’s wheels or engine—causing violent neck breaks and crushed windpipes. In one horrific accident (not one of our facilities), a woman was literally decapitated when her hijab was snagged around her neck and she crashed
    into a wall. Severe injuries can result, such as permanent damage to one’s throat, vertebrae, and voice‐box.

    • Hazard to Other Drivers: You may not think that your simple cap, bandana, visor, etc. is a hazard.

    However, when you are driving a go‐kart, headwear and neckwear can easily fall off or fly off. Such an airborne item may at minimum distract other drivers, causing them to abruptly swerve away from the object—and thereby crash. Air‐borne items can also hit other drivers in the eyes, causing severe eye
    injury. Loose headwear and neckwear can also become dislodged and jam into a go‐kart’s machinery, which may cause a driver to lose control and crash into a
    wall or other go‐kart.
