Burail Jailbreak Case: Restriction on Bhai Tara relaxed for Production in Court

CHANDIGARH, Punjab—Chandigarh Administrator, Kaptan Singh Solanki, on Thursday granted approval for temporary ‘relaxation’ on the restriction imposed on movement of Sikh freedom fighter Bhai Jagtar Singh Tara outside the Burail Jail.  Bhai Tara would finally be produced in the court in coming days. During his production, the police appeal for his custody in jailbreak case will come up for hearing.

On Wednesday, the court had, for the third time this week, issued production warrants for Bhai Tara after his lawyer stated earlier before the court that he was not aware whether Bhai Tara has engaged him as his counsel in this case or not and thus Bhai Tara should be summoned for arguments on appeal for his police custody.

The restriction has been relaxed till the time Bhai Tara’s presence is required by the police in Burail jailbreak case.

Twice this week, the Burail Jail authorities had expressed their inability to produce Bhai Tara in court as he was under restriction with Section 268 CrPc (person shall not be removed from prison till completion of the trial) still imposed on him.

Bhai Jagtar Singh Tara along with his aides Bhai Jagtar Singh Hawara, Bhai Parmjit Singh Bheora and Devi Singh, planned to assassinate the then Punjab chief minister Beant “Singh” in order to punish him for his atrocities committed on people of Punjab during later stage of armed Sikh freedom movement. They had escaped from Burail Jail on the intervening night of January 21 and 22, 2004, by digging a long tunnel. Bhai Hawara and Bhai Bheora were arrested later on and have been convicted in the Beant “Singh” assassination case in 2007 while the Burail jailbreak case against them is at the final stage. After remaining underground for 11 years, Bhai Tara was arrested in Thailand in January this year and extradited to India on January 17.
