DSGMC moves petition in High court seeking transfer of Sajjan Kumar case to another court

2014-06-20-sajjan kumarNew Delhi, India—Accepting the petition of Delhi Sikh Gurdwara Management Committee, Justice Sidhartha Mirdul has issued stay on the case forcing a lower court to stop the hearing on the 1984 anti-Sikh Pogroms.

The DSGMC had earlier moved the petition in High Court alleging of legal terms violation while recording witnesses by Justice Kamlesh Kumar of Kadkaddooma court and had sought transfer of the case to another court.

Addressing media gathering outside High court, DSGMC’s General Secretary Manjinder Singh Sirsa elaborated on the reasons for moving the petition. He clarified that while recording witness of Sheela Kaur, Justice Kamlesh Kumar disobeyed the legal procedure of recording witnesses. He asserted that Sheela Kaur is illiterate and frightened of the witness of the case, namely Sajjan Kumar. She couldn’t present her sufferings due to usage of mix up of Punjab and Hindi language. He alleged that Justice Kamlesh Kumar didn’t compromise with the witness Sheela Kaur.

Sirsa expressed suspicion that the order of translation of Sheela’s statement might be an attempt to mischievously alter Sheela’s statement.  

Sirsa stated that DSGMC respects and believes in Indian judiciary, but they will not let the witnesses get exploited in lower courts due to illiteracy, language and financial problems.
