Five 1984 Sikh Genocide Cases Reopened By Delhi High Court

NEW DELHI, India—A Delhi High Court bench comprising of Justice Gita Mittal and Justice Anu Malhotra ordered the retrial of five criminal cases yesterday, pertaining to the 1984 Sikh genocide. The Delhi High Court issued the directions after examining trial court records surrounding the acquittal of an accused culprit.

The trial court records were placed before the high court by the CBI during the hearing of another 1984 Sikh genocide case in which the acquittal of Congress leader Sajjan Kumar has been challenged. When going through the records, the bench observed that neither the witnesses nor the complainants were examined properly by the trial courts and the verdict was issued in a rush.

The High Court has directed the Delhi Police to investigate the matter and has fixed April 20 for the next proceedings. The complainants have also been asked to appear before the court on April 20.

Various accused including ex-councilor Balwan Khokkar, former MLA Mahender Yadav and Ved Prakash have also been issued notice by the Court.

While perusing trial Court records, the high court found that in some cases, complainants were not even issued a summons as they were sent to the addresses of houses which were burnt during 1984 Sikh genocide.

    Mahatma Gandhi never got us all of freedom.
    It was gifted to us by the Britishers .
    Like all Empires the Sun had begun to set on the British Empire .
    They in turn began handing over the Empire to Americans.

  3. You are right, atleast sikhs & Muslims should learn all the stages of genocides, their characteristics & preventing measures. Sikhs should go back & look how indira government changed the movement of more rights to khalistan, how they termed sant Jarnail Singh ji Khalsa as terrorist. How their agencies committed the crimes & blamed Sant ji & other Sikh jathebandies & attack Darbar Sahib, other gurdwaras, in delhi & other parts of India and killed thousands of sikhs.

    So as to take preventive measures.
    Thing which we must do to avoid another genocides is to

    1) Avoid Traps of provocations
    2) Avoid getting a label of Terrorist
    3) Have a genocide exit policy
    4) Have a pan universe distribution
    5) Have a genocide monitoring group in SGPC which will give an advance warning on an impending genocide
    6) Be careful of Fanatics,Fascist, racist, imperialists and hyper nationalists ideologies

  6. The people & parties responsible for a genocide leave a big black dirty scar on their faces forever. We know we will never get justice from the genociders of the country. The rule of genociders is finished but their supporters are ruling. We don’t know if we will see the rule of justice & equality ever in India. May God give some wisdom & heart filled with humanity to the people of India so that they can find good leaders & people can live normal life.

  8. This massacre of innocent civilians occurred in broad daylight in one of the world’s largest capital cities over 32 years ago. If the justice system, and the Constitution that defines it, has failed, how will reopening cases change anything?
