Shock to Sajjan Kumar: Court Dismisses Plea in 1984 Sikh Genocide Case

NEW DELHI—Earlier today, a Delhi court dismissed the pleas of Congress leader Sajjan Kumar and three of his associates in a 1984 Sikh genocide case.  The accused sought transfer of the case on the ground of jurisdiction.  Interestingly, a petition was filed seeking transfer of the case from Karkardooma district court in East Delhi to Rohini district court, the petition was however rejected by District Judge Rakesh Siddhartha.

Namely, Sajjan Kumar, Brahmanand Gupta, Peeriya and Ved Prakash are facing trial on charges of murder and instigating mobs against the Sikhs in Sultanpuri area of West Delhi.  It was argued by the CBI prosecutor DP Singh that district judges do not have the power to transfer cases from their division to another.  This power lies only with the High Court.

In 2010, various charges were framed against the accused in relation to murders of Sikhs.  The charges were filed on the recommendation of Justice GT Nanavati Commission.
