NEW DELHI—The Supreme Court of India has quashed the plea by Jagdish Tytler seeking a stay on investigations by the CBI.  The CBI was directed by the Delhi High Court to re-investigate allegations against Tytler for his role in the 1984 Sikh Genocide in New Delhi.  Tytler, along with other leaders were witnessed as instigating mobs against Sikhs in various parts of Delhi.

The Supreme Court bench headed by Justice P Sathasivam refused to hear the plea by Tytler on the basis that the case is pending in the Delhi High Court.  The hearing is scheduled to take place on September 18 after CBI investigations take place.

The decision by the Supreme Court is said to have shaken Tytler.  Tytler alleged that he was hopeful that the Apex court would hear his appeal.  Senior Advocate H.S. Phoolka told the press that the CBI was told by the High Court to fully re-investigate the case against Tytler and to record testimonies by various witnesses it had chosen not to interview.

The CBI’s role in Jagdish Tytler’s Sikh genocide case has long been questioned.  Despite there being credible proof of his involvement in the mass murders of Sikhs, the CBI had let Tytler off the hook.  It failed to record testimonies of various Sikhs who had witnessed Tytler instigating mobs after the assassination of Indira Gandhi.

DSGMC President Manjit Singh GK welcomed the decision by the Supreme Court alleging that the police and Delhi High Court had shielded Tytler.  He said that the Government is trying to save Tytler because many of its other leaders are known to have taken part in the genocide.  He asked that the Delhi High Court judges take lessons from the Supreme Court and take rightful action against Tytler by not bending to political pressure as they have in past.
