Mohali Court rejects Sumedh Saini’s plea seeking interim bail in Balwant Singh Multani case

CHANDIGARH, Punjab—On July 10, the Court of District Session Judge Rajneesh Garg rejected Ex-DGP Sumedh Saini’s plea seeking interim bail in Balwant Singh Multani’s enforced disappearance case. However, the Court directed police to give a three days prior intimation to Sumedh Saini if Section-302 of IPC is invoked against him in the FIR pertaining to the disappearance of Balwant Singh Multani.

During the proceedings on Sumedh Saini’s bail plea, Public Prosecutor Sartej Singh Narula and District Attorney Sanjeev Batra contended that Sumedh Saini can’t be given interim bail in section-302 of IPC because this section has not been invoked in the FIR.

Prosecution lawyer Pardeep Virk also demanded scrapping of Sumedh Saini’s plea seeking interim bail before the Court.

Defense lawyer H.S. Dhanoa demanded that the police should give a prior notice before arresting Sumedh Saini.

After hearing the arguments, Judge Rajneesh Garg scrapped Sumedh Saini’s interim bail plea while directing police to give a prior notice before arresting Sumedh Saini in this case.

Meanwhile, it is learnt that the bail pleas of other accused SI Jagir Singh and SI Anokh Singh will be taken up on July 17.

Case Background:

In 1991, the Chandigarh police had abducted Balwant Singh Multani from his residence immediately after an attack on Sumedh Saini in Chandigarh. Four cops deployed in the security of Saini were killed in this attack while he survived the attack.

As per an eyewitness Gursharan Kaur Mann, Balwant Singh Multani was brutally tortured by the cops at the behest of Sumedh Saini. The cops killed him by pushing stick in his anus. 

In 2007, the Punjab & Haryana High Court had ordered a CBI inquiry. The CBI had found enough evidence against Sumedh Saini after which an FIR was registered against Sumedh Saini along with three other cops namely SP (Operations) Baldev Singh Saini, SI Harsahai Sharma and Jagir Singh on July 4, 2008.

Later, this FIR was quashed by the Supreme Court of India after Saini challenged CBI inquiry and the High Court’s decision.

On May 6, the Mohali police registered a fresh FIR on the complaint of victim Balwant Singh Multani’s brother Palwinder Singh Multani against Sumedh Saini, SP (Operations) Baldev Singh Saini, SI Harsahai Sharma, SI Jagir Singh, SI Savir Singh, SI Anoop Singh, Kuldeep Singh and other unknown police cops.
