:dateline:Senior lawyer Advocate Harvinder Singh Phoolka has written a letter to the Punjab CM Captain Amarinder Singh seeking indictment of four Shiv Sena affiliated Hindu leaders who spread the virus in Rajpura by misusing the curfew passes obtained under the pretext of organizing langar. Notably, these persons had organized Hukka parties after which the coronavirus spread in Rajpura.�
Expressing dissatisfaction over an FIR� registered against these four persons simply for violating curfew, HS Phoolka has sought their indictment under sedition as well as fraud charges.�
“They had obtained the pass by playing a fraud on the government and actually they intended to use this pass for their business purposes, so they should also be held liable for cheating the government and the case under section 420 IPC should also be registered against them. It is a fit case where NSA as well as section 124 IPC should be used,” he wrote in the letter.�
“These people have created havoc in the whole area and as a result of that the Rajpura city has been sealed and Patiala Distt. is declared as a hotspot,” Phoolka wrote.�

Sir,
It has come in the media that in Patiala Distt in Rajpura city, four people had taken the Pass for distribution of Langar but misused those passes for their business purposes and also held Hukka Parties and now all those have been tested positive of COVID -19 and alongwith them 41 other persons in the city of Rajpura connected with them and who had attended the Hukka Party have also found positive. These people have created havoc in the whole area and as a result of that the Rajpura city has been sealed and Patiala Distt. is declared as a hotspot.
Sir, I have read in media that against these 4 persons, FIR has been registered for violation of curfew. But in actual fact a stringent action should be taken against these people to set an example that nobody should violate the law like this and try to spread the virus in such a manner like they have done.

Sir, a serious investigation in this matter is expected from you. Punjab Government which is otherwise doing a good job but in this case a very lenient approach has been adopted.
I humbly request you to take a stern action against these people and all of them who have violated the Curfew in such manner should be held responsible and should be arrested and a Criminal case should be registered against them.

Multiple sections under the law have to to levelled against the violators. Also, don’t forget that it is a major violation under the COTPA act of Punjab, which is implemented by the Health, Police, NGOs departments.
