1984 Sikh Genocide: Supreme Court Issues Notice to Sajjan Kumar

:dateline:A Supreme Court bench of Justice A.K. Sikri and Ashok Bhushan on July 5 issued a notice to the Congress leader Sajjan�Kumar, seeking�his response�to�a petition moved by the Special Investigation Team (SIT) challenging his interim bail upheld by the Delhi High Court. Notably, Sajjan Kumar is a key culprit of�the 1984 Sikh genocide�who is a testimony of the failure of Indian judiciary in delivering justice to the genocide victim families.

Wondering over the 200 pages verdict of Delhi High Court upholding the interim bail of Sajjan Kumar, the SC bench said that it was an over 30-year-old case and it took around �200 pages� for the high court to grant anticipatory bail when it could have been done in just �40-50 pages�.

Appearing before the SC bench on the behalf of SIT, the Additional Solicitor General Mr. Maninder Singh said that the investigation was started against Sajjan Kumar only in 2016 and now he has come armed with a battery of lawyers and dictates his statement to the investigating officer of the case.

The ASG told the SC bench that while granting anticipatory bail to him, the High Court had said that everything will be tested in�the trial�of the�case, but�at the end it granted him the relief saying there was no evidence.

To this, the Bench said whether all this was considered at the time of anticipatory bail?

The ASG said, �Yes. This is totally contrary to the established procedure of law.�

It may be recalled here that the Delhi High Court, on February 22, upheld a trial court order granting anticipatory bail to Sajjan Kumar in two Sikh genocide cases of 1984, saying that according to records, he was available throughout the investigation.

Sajjan Kumar is facing two cases pertaining to Sikh genocide registered in the Police stations of Janakpuri and Vikaspuri of West Delhi. The complaint in Janakpuri police station pertains to the killing of two Sikhs, Sohan Singh and his son-in-law Avtar Singh, on November 1, 1984. He was granted an anticipatory bail in these cases by the trial court on December 21, 2016.
