:dateline:The Additional Sessions Judge Atul Kasana today framed charges against Akal Takht Jathedar Jagtar Singh Hawara in a case pertaining to bomb blast in Ludhiana on December 6, 1995. Jathedar Jagtar Singh Hawara today attended the Court hearing via video conference.
An FIR no. 133 was registered on December 6, 1995 in the Police Station of Kotwali under sections 307 and 427 of Indian Penal Code and sections 3, 4, 5 of Explosives Act after the bomb blast had occurred near Ghantaghar Chowk of Ludhiana. The FIR was registered on the complaint of a lottery seller Vinod Kumar, and the name of Jathedar Jagtar Singh Hawara was inducted in this case on December 12, 1995 in the statement of an eye-witness Mall Singh.
Speaking to Sikh24, Advocate Jaspal Singh Manjhpur informed that Jathedar Hawara was arrested in this case on December 23, 1995. He added that due to imposition of civil code in Beant Singh assassination case Jathedar Hawara was not produced before the Court in this case and in May 2015 he had moved an application restart proceedings of the case. He further informed that the Court has deferred hearing in this case onto June 5, 2017.
Advocate Manjhpur said, “Rajesh Kumar, Additional Sessions Judge, Ludhiana�dismissed the bail application of Bhai Jagtar Singh Hawara in Case of blast�and attempt to murder (307) at Ghanta Ghar, Ludhiana�on June 12, 1995.” �He added that Bhai Jagtar Singh Hawara�has been in custody in this case for�more than 21 years but till date no bail has been provided. �He shamed the Judiciary for not granting bail.
Judge Rajesh Kumar ruled that “applicant/accused Jagtar Singh @ Hawara does not deserve the benefit of regular bail. Grant of regular bail in this case shall give a wrong signal in the society and the applicant and the like minded people shall feel encouraged by grant of regular bail in this case. Possibility of influencing the witnesses by the applicant/accused while out of jail, cannot be ruled out. “

After spending almost 22 years in jail for the alleged crimes happened in 1995 equivalent to almost three life sentences without any trial or judgement the honourable Judge Rajesh Kumar said granting bail to S. Hawara will send wrong signal to society. At the same time provide security as well as bails to Mr Tytler is perfectly normal. Justice Indian style.
