SYL-Canal: Central Government refuses to recognize Punjab Termination of Agreement Act of 2004

syl-580x395:dateline: On April 1, the five member constitutional bench headed by Justice Anil R. Dave said that it was highly important to know the legal validity of the Punjab Termination of Agreement Act of 2004, which was passed by the Punjab assembly unanimously. The members of the bench advised the Punjab government to get clarification from the��central government about whether the act was legally recognized. �The members of the bench asserted that the case couldn�t proceed�if the Punjab Termination of Agreement Act of 2004 passed by the state assembly of Punjab didn�t possess legal validation.

The Punjab Termination of Agreement Act of 2004 was passed by the state assembly of Punjab in 2004, canceling�all of Punjab�s pacts with neighbouring states. This move was made�while Captain Amarinder Singh led the Punjab government and it followed the Supreme Court�s directive to the central government to use its agencies to complete the SYL-Canal in Punjab.

In a debate lasted for more than two hours, the constitutional bench asked the central government to clarify its stand about the legal validity of the�2004 act. At this, the solicitor general�of the central government,�Ranjit Kumar told the court that the central government was neutral about the SYL Canal.

This development has made it clear that there are now more legal obstacles in the way of Punjab�s ability to defend its rivers.
