1984 Sikh Genocide: Delhi High Court demands statements of victims against Sajjan Kumar from SIT

NEW DELHIā€”A Delhi High Court bench headed by Justice Anu Malhotra on December 11 directed the Special Investigation Team (SIT) to submit the statements of Sikh genocide victims who have deposed the involvement of Congress leader Sajjan Kumar in the barbaric carnage carried out in Delhi in November 1984. The Delhi High Court made this direction while processing a petition seeking cancellation of anticipatory bail granted to Sajjan Kumar last year in two cases of murdering three Sikhs during Sikh genocide.

Sikh24 has learnt that the Delhi High Court has also sought the statements of victims and witnesses recorded by the police and the magistrates during and after lodging of the FIRs in the genocide cases.

Additional Solicitor General (ASG) Sanjay Jain, who is representing the SIT in this case, was asked by the Court to provide the copy of these statements to the counsel for the Sajjan Kumar.

Seeking cancellation of anticipatory bail granted to genocide perpetrator Sajjan Kumar by the trial court, ASG Sanjay Jain informed the Court that some of the witnesses were not coming forward in fear of Sajjan Kumar who is roaming openly despite of serious criminal charges against him. He added that the witnesses and their families as well as the kin of the victims of the genocide had fled to Punjab fearing for their lives and it was only now that they were coming forward.

Defense counsel Advocate Anil Sharma, appearing for Sajjan Kumar, opposed the contentions of ASG by saying that the trial court’s order was well reasoned and even after grant of the bail, his client was never called for interrogation.

It may be recalled here that Sajjan Kumar was granted anticipatory bail by a trial court on December 21 last year in a case of killing of three Sikhs during the genocide of Sikhs committed after the assassination of then Prime Minister Indira Gandhi.

Sajjan Kumar facing two cases pertaining to Sikh genocide registered in the Police stations of Janakpuri and Vikaspuri of West Delhi. The complaint in Janakpuri pertains to the killing of two Sikhs, Sohan Singh and his son-in-law Avtar Singh, on November 1, 1984 and in the other, where another Sikh, Gurcharan Singh, was burnt on November 2, 1984 in the jurisdiction of Vikaspuri Police Station. Gurcharan, who was half burnt, had remained bed-ridden for 29 years. He had died three years ago.

  1. Is govt still providing security to Mr Sajjan Kumar ? After 33 years they are looking for statements of persons who have long died. I want to see if any minority community has committed any of these massacres how long it would have taken the govt to provide justice ? Can anyone imagine to live with burnt body for 29 years and the fellow who did that was protected by the govt and roamed free ?
