High Court Petition To Commute Bhai Rajoana’s Death Sentence

CHANDIGARH, Punjab—Bibi Kamaldeep Kaur Rajoana has moved a petition in the Punjab & Haryana High Court, seeking commutation of the death sentence of her foster brother, Bhai Balwant Singh Rajoana to life imprisonment. Bhai Balwant Singh Rajoana is a death row convict in the CM Beant Singh’s assassination case and is currently confined in the Central Jail of Patiala.

The petition has been lodged via Gursharan Kaur Mann against the union government of India. The High Court bench, headed by Justice Rakesh Kumar Jain, conducted a preliminary hearing yesterday and adjourned the hearing until November 2 in order for Mann to give the court locus standi – the ability of a party to demonstrate to the court sufficient connection to a court.

Contending the court, Gursharan Kaur Mann said that Bhai Balwant Singh Rajoana had been languishing in prison for 22 years. “Almost a decade has passed since the death sentence was pronounced and seven years have lapsed since it was confirmed”, she added.

Mann added that the petitioner’s sister believed that Rajoana had experienced immense pain and suffering due to the delay in carrying out the sentence after it’s confirmation by the HC.

“This extraordinary and unjustified delay in the carrying out of his death sentence has also caused physical and mental agony to the petitioner and her family,” she said.

She further argued that Rajoana refused to seek legal representation during the course of his entire trial. She added that Bhai Rajoana did not even file an appeal against his death sentence, which was confirmed by the HC.

  1. I am urging the Indian government to Release Balwant Singh Rajoana, it’s time for us to heal. He’s spent 22 years in jail that’s life sentence itself.
